ARTICLE 1 – PURPOSE

These GTC define the conditions under which YFS markets and sells sport fishing trips, halieutic journeys, nautical services and associated travel services.

All trips are sold as packaged or customized products.

ARTICLE 2 – SCOPE OF APPLICATION

These GTC apply to all sales made by YFS, unless expressly agreed otherwise in writing.

Any promotional materials, images, videos or content published on the website are non-contractual.

ARTICLE 3 – PRE-CONTRACTUAL INFORMATION

Prior to any booking, the client acknowledges having received all necessary information relating to the trip, including through:

• customized quotations,
• programs,
• Travel contract
• or any commercial proposal issued by YFS.

The client undertakes to inform YFS, prior to booking, of any personal circumstances that may affect the trip (health conditions, administrative constraints, required documents, etc.).

ARTICLE 4 – FORMATION OF THE CONTRACT

The contract is deemed concluded as soon as:

• the booking is validated online,
• or the travel contract is signed,
• or a deposit is paid.

Any booking constitutes a firm and binding commitment by the client.

ARTICLE 5 – PRICES

Prices are expressed in euros (€) and correspond to the services described in the quotation or travel contract.

5.1 Services Not Included

Unless otherwise stated, prices do not include:

• personal travel insurance,
• international flights,
• alcoholic beverages,
• specific fishing equipment (jigging / popping),
• satellite phone, internet,
• tips,
• landing or disembarkation fees for outer islands.

ARTICLE 6 – PAYMENT TERMS

6.1 Bookings made more than 180 days prior to departure

• At booking: 20% non-refundable deposit
• 180 days prior to departure: 30% deposit
• 90 days prior to departure: 50% balance

6.2 Bookings made less than 180 days prior to departure

• At booking: 50% deposit
• 90 days prior to departure: balance payment

6.3 Bookings made less than 90 days prior to departure

• Full payment (100%) due at booking

Failure to comply with payment deadlines entitles YFS to cancel the booking without refund of amounts already paid.

ARTICLE 7 – CANCELLATION BY THE CLIENT

Any cancellation must be notified in writing (email or registered letter).

7.1 Cancellation Fees

• Up to 180 days prior to departure: 20% of the total price
• 180 to 120 days prior: 30%
• 120 to 90 days prior: 50%
• Less than 90 days prior to departure: 100%

Flight tickets, insurance premiums, administrative fees and specific services are non-refundable.

ARTICLE 8 – MODIFICATION BY THE CLIENT

Any modification requested by the client prior to departure is considered a cancellation followed by a new booking.

After departure, no modification may be made without prior written approval from YFS.

No refund shall be granted for services not used due to the client's own actions.

ARTICLE 9 – MODIFICATION OR CANCELLATION BY YFS / VOUCHERS

YFS reserves the right to modify or cancel all or part of a trip for reasons including, but not limited to:

• safety and security considerations,
• adverse weather conditions,
• technical, logistical or regulatory constraints,
• force majeure or exceptional events.

In certain exceptional situations (force majeure, major operational constraints, or specific circumstances), YFS may offer the client a financial compensation in the form of a voucher.

Voucher Terms and Conditions

• Vouchers are strictly personal and nominative
• They are valid only for a future fishing trip organized by YFS
• They cannot be sold, transferred, exchanged or refunded, in whole or in part
• Their validity period will be specified at the time of issuance
• Acceptance of a voucher constitutes full and final settlement and excludes any further claim for refund or compensation.

ARTICLE 10 – TRAVEL INSURANCE

For all trips taking place abroad, YFS systematically offers clients the option to purchase a travel insurance policy through its insurance partners.

Subscription to this insurance is entirely optional and remains at the sole discretion of the client. When subscribed, the cost of the insurance is borne exclusively by the client and is added to the price of the trip.

Clients are also free to purchase travel insurance from an insurer of their choice, provided that such insurance adequately covers the risks associated with the trip (accident, illness, repatriation, trip interruption, etc.).

⚠️ Booking a trip with YFS does not, under any circumstances, mean that the client is insured for the trip.

In the absence of insurance coverage (whether through YFS or a third party), the client acknowledges and accepts full responsibility for all risks and costs that may arise before, during or after the trip. YFS shall not be held liable for any financial consequences resulting from a lack of insurance.

ARTICLE 11 – LIABILITY AND RISKS

The client acknowledges that sea fishing activities involve inherent risks related to navigation, weather conditions, marine fauna, and the use of specific equipment.

YFS shall not be held liable for any bodily injury, material or immaterial damage resulting from:

• failure to comply with safety instructions,
• reckless or inappropriate behavior by the client,
• natural phenomena or external events beyond YFS's control.

ARTICLE 12 – EQUIPMENT AND DAMAGES

Any damage caused by the client to vessels, equipment or fishing gear provided by YFS shall be borne by the client.

Clients remain solely responsible for their own personal fishing equipment.

ARTICLE 13 – IMAGE AND VIDEO RIGHTS

Unless expressly opposed in writing, the client authorizes YFS to use, free of charge, photographs and videos taken during the trip for communication and promotional purposes.

This authorization is granted worldwide and for an unlimited duration.

ARTICLE 14 – PERSONAL DATA

Personal data collected by YFS is used solely for booking management purposes and in accordance with applicable data protection regulations.

ARTICLE 15 – APPLICABLE LAW AND JURISDICTION

These GTC are governed by Monégasque law.

Any dispute shall fall under the exclusive jurisdiction of the courts of Monaco.
